Commercial Law And Property

This section is supervised by Glen Morrow, and assisted by Sandra Robinson and Col Price.

We have experience in most of the areas of commercial law that need to be dealt with in the North Queensland region.

  • Corporate and Commercial: Negotiation and drafting of joint venture, shareholder and other commercial agreements, corporate and regulatory advice.
  • Business: Business sales and purchases, business establishment and management buyouts.
  • Commercial Property: Development, sub-divisions, commercial and residential leasing, conveyancing and commercial property projects. Total solutions offered for commercial property development, commercial and retail leasing, acquisitions and disposals, and due diligence investigations.
  • Conveyancing:Buying or selling property can often be a stressful experience with people making significant decisions. The systems that we have in place at Morrow Petersen Solicitors ensure that your transaction will proceed as smoothly and efficiently as possible to ensure peace of mind.

We also provide advice and act in Body Corporate matters, commercial property conveyancing, unit and land subdivision. We understand all State and Federal Government town planning legislation affecting property developments.

Col Price is responsible for our Conveyancing and Property section. Col has many years experience in property related matters and is always available to assist clients at any stage during the conveyancing process, whether it be preparation and negotiation of contracts, disputes or simply discussing the conveyancing process to ensure the transaction is completed efficiently for each client.

All staff in our conveyancing section are involved in ongoing legal education to ensure our knowledge is kept up to date at all times.

General And Commercial Litigation

Our general and commercial litigation section is supervised by Glen Morrow, assisted by Paul Frost.

This section deals with a wide range of commercial and general litigation and regularly acts in a variety of matters, including disputes over contracts, leases of property, corporate and personal insolvencies, voluntary administrations, Trade Practices disputes, copyright patents and trademarks, debt recovery, defamation and insurance matters.

The group also frequently handles litigation relating to construction and building disputes and associated matters, achieving optimal results by adopting the most appropriate traditional or non-traditional dispute resolution method.

Litigation in any form can be stressful and have dramatic financial consequences whether you are an individual, a business or company.

We have acted for both plaintiffs and defendants in disputes involving several thousand dollars, right through to large claims involving millions of dollars.

The success of our litigation practice derives from achieving results, often in difficult circumstances, and our exceptional skills and knowledge of the relevant law.

Our Approach To Representation In Court

We encourage our solicitors to appear personally before the courts and tribunals with which we deal. We appear regularly in Court, including the Federal Magistrates Court, the Queensland Supreme, District and Magistrates Courts, and various tribunals. Our solicitors perform most of their advocacy work in the lower courts, only engaging counsel in some of the more complex matters.

We strongly advocate negotiated settlements where possible but will not advise our clients to settle without all relevant information being available, and even then only in circumstances where the settlement is fair, equitable and cost effective.
